Christmas Workers Beware!

Scenario Question

I work in a well known busy restaurant chain and whilst on shift at the weekend, slipped on a spilt drink that should have been cleaned up. I hurt my arm as a result of the fall and went to hospital after my shift.

It is now in a sling and will be for a few weeks and will require physio. I am unable to work, as I can’t carry out my duties with one arm, am I able to claim Workers Compensation?

Answer

You don’t mention in your enquiry whether you told your employer that you were hurt whilst on shift at his/her restaurant?

If you do have an accident at work you need to ensure that you tell your employer immediately so as your rights to Workers Compensation are not compromised!

As you did seek medical advice and went to the hospital, make sure that you are able to obtain your medical notes, as these will be needed.

Your injury was the result of someone else’s negligence, and you will be entitled to workplace damages as a result of this negligence.

If this happens to you and you are working in the hospitality industry, especially with the busy Christmas season approaching, you need to ensure that you follow the above and then seek expert legal advice from an Accredited Workers Compensation Lawyer.
